2 WHARF FEST SPONSORHIP About The Fisherman's Wharf Community Benefit District The Fisherman s Wharf Community Benefit District (FWCBD) was founded in November of 2005 by the business and property owners of the San Francisco neighborhood. The district is funded through an annual assessment for 15 years from the property owners. The association is also a 501(c)(3), which allows the organization to apply for federal, state and locally funded grants, as well as to seek out sponsorships from companies with a philanthropic division. The Community Benefit District serves as a catalyst for unification of Fisherman's Wharf constituents to support a positive change to their San Francisco neighborhood. The purpose of the FWCBD is to preserve and enhance its vast waterfront landscape and multi-cultural heritage, while integrating modern efficiencies to enrich the experience of visitors from both near and far through market research, brand and destination marketing, sidewalk operations, district beautification, traffic and urban planning, and emergency preparedness. About The Fisherman's Wharf District Fisherman s Wharf is the number one destination in San Francisco and PIER 39 is the most visited attraction. As a destination, over 12 million people visit Fisherman s Wharf annually. During certain months, Jefferson Street, the main thoroughfare of the neighborhood, receives more pedestrian traffic than Times Square in New York City. The intersection of Jefferson & Taylor Streets is one of the busiest pedestrian intersections in the country and can swell to approximately 90,000 people per day. Our website, VisitFishermansWharf.com, receives approximately 30,000 unique visitors per month. 25% of visitors to Fisherman s Wharf are San Francisco and Bay Area residents. Fisherman s Wharf has 13 hotels with a total of 3,200 guest rooms. Fisherman s Wharf is the #6 top attraction in the US - Forbes Magazine. It attracts both visitors and locals to celebrate all things Fisherman's Wharf. It takes place at the central hub of the district near the iconic Fisherman s Wharf crab wheel sign. An estimated 30,000 people visited Wharf Fest in 2016, including over 600 attendees of ticketed events and festival programming including the chowder competition and music performances. The majority of festival attendees are local Bay Area millenials and national and international tourists. At the annual chowder competition 12 Fisherman's Wharf restaurants battle for the coveted honor of Best Chowder at Fisherman's Wharf. A winner is chosen from the people's choice and judges choice. Judges typically include prominent political figures and local media personalities. The event is produced by Steven Restivo Event Services (SRES). SRES is the top event production company in the Bay Area and produces legendary neighborhood festivals such as Fillmore Jazz Festival, The St. Patrick s Day Festival, North Beach Festival, and more. The event is free to the public. 2. SPONSOR will promote and market its products and services at the event. Any premium giveaway items must be approved by Steven Restivo Event Services, Inc prior to the event. All activity related to the promotion will take place within the confines of the booth space only at the event. There are no roaming rights granted to you at the event, unless otherwise specified. There will be no direct sales of products at the event from the space, unless otherwise approved. 3. In consideration of all rights granted you in this agreement, SPONSOR agrees to pay Steven Restivo Event Services, Inc, a total cash sponsorship fee for participation in the event. SRES will a participant packet to SPONSOR that contains all necessary set up information 20 days prior to the Festival. 4. SPONSOR agrees to indemnify and hold harmless Steven Restivo Event Services, Inc and each of its officers, employees, directors and agents or clients from all claims, liabilities, costs or expenses, including reasonable attorneys fees that arise from or may be attributable to any error, omission or fault of SPONSOR. SPONSOR indemnification obligations hereunder will survive the termination or expiration of this Agreement. 5. Once we have a completed executed sponsorship agreement and payment for the Festivals SPONSOR has agreed to participate in, there are no refunds available. All sponsorship fees will be committed to the promotion, marketing, advertising and production of the events. We may in, some cases, be able to forward the sponsorship fees to other events within the same calendar year. All cancelation requests must be made in writing and received by our office via fax, or regular mail. Please site the reason for the cancelation. 6. Each party represents and warrants that it is free to enter into this Agreement without violating the rights of any person, that its trademarks do not infringe on the trademarks or trade names of any person and that it will comply with all laws and regulations pertinent to its business. 7. SPONSOR shall name Steven Restivo Event Services, INC, its officers, agents and employees, its client, and the City where the event takes place as additional insured on its insurance and provide Steven Restivo Event Services, Inc a certificate of the insurance prior to the events. If we do not receive the insurance certificate prior to the event, you will not be able to set up. Please include the following additional insureds on the insurance cert: Steven Restivo Event Services, INC, its officers, agents and employees, Fisherman s Wharf Community Benefit District, and the City and County of San Francisco 8. Let it be known that Steven Restivo Event Services, Inc is not liable for any failure to perform hereunder resulting from unforeseen events or circumstances beyond its control including, but not limited to, any delay, postponement or cancellation due to adverse weather, other natural catastrophes, labor disputes, strikes, wars, riots, insurrections, civil commotions, fire, flood, accident, act of God, Terrorism or other conditions beyond its control. 9. This Agreement does not constitute a partnership or joint venture or principal-agent relationship between us. It shall be governed by the laws of the State of California. It is complete and represents the entire agreement between the parties. 10. SPONSOR is responsible for any additional costs it incurs in excess of agreed upon amounts above.
