1 FEDERAL ENERGY REGULATORY COMMISSION ENVIRONMENTAL COMPLIANCE MONITORING PROGRAM WEEKLY SUMMARY REPORT NEXUS GAS TRANSMISSION PROJECT DOCKET NO.: CP FOR THE PERIOD: FEBRUARY 12 THROUGH FEBRUARY 18, 2018 On August 25, 2017, the Federal Energy Regulatory Commission (FERC) issued a Certificate of Public Convenience and Necessity (Certificate) under section 7 of the Natural Gas Act for authorization to construct and operate the NEXUS Gas Transmission, LLC (NEXUS) NEXUS Gas Transmission Project (Project). The Project consists of about miles new of 36-inch-diameter pipeline and associated facilities, including about miles of new pipeline in Columbiana, Stark, Summit, Medina, Lorain, Huron, Erie, Sandusky, Wood, Lucas, Henry, and Fulton Counties, Ohio; and about 48.1 miles of new pipeline in Lenawee, Monroe, and Washtenaw Counties, Michigan; four new natural gas-fired compressor stations, and associated facilities/aboveground appurtenances. As committed to in its application and in accordance with the Order for the above referenced docket, NEXUS agreed to fund an (Program) during construction of the Project. This report provides a summary of the FERC Compliance Monitors construction review for this reporting period. Three Program Compliance Monitors (CMs), Aric Donajkowski, Tom McDonald, and Tina Webb are conducting daily inspections documenting compliance with the Project s environmental requirements along the Project s right-of-way. The compliance monitors are responsible for reviewing NEXUS s construction and documenting compliance with the FERC Certificate. 2 COMMUNICATION REPORTS NEXUS Gas Transmission Project, Docket No.: CP Communication reports provide documentation of relevant meetings between the FERC CM and landowners, agencies, Project representatives, Environmental Inspectors, and/or Contractors. The eight communication and follow-up reports represented below capture compliance related information for keeping this weekly summary report relevant to current Project activities. Date SUMMARY OF COMMUNICATION REPORTS FOR THE NEXUS GAS TRANSMISSION PROJECT FEBRUARY 12, 2018 THROUGH FEBRUARY 18, 2018 Spread/ Facility 2/12/18 Meter Station 01 Location (Milepost) Follow-up Required If Applicable (Yes or No) Communication Description 0.0 Yes The CM observed silt fence on the south side of the meter station 01 site requiring cleaning out. Additionally, the CM observed an area requiring slope breakers at the base of the parking area. The CM noted the existing onsite erosion and sediment control devices (ECDs) were still effective however; the weather forecast was calling for rain later in the week. The CM communicated the concerns to the Lead Environmental Inspector (Lead EI). The CM followed-up on February 14 and observed the ECDs to be cleaned out and slope breakers added resolving the previously noted concerns from February 12. 2/12/ Yes The CM observed a rock construction entrance (RCE) requiring repair. The geotextile fabric installed under the culvert (flume pipe) was not cut short enough and could blow over the end of the culvert and obstruct water flow within the bar ditch during a rain event. The culvert opening on the south end was obstructed by straw. The CM contacted the EI with the concerns and the EI confirmed the issues would be resolved. The CM followed-up on February 16 and observed he culvert opening free from any obstruction and the previously noted concerns to be resolved. 2/13/ No The CM followed-up on a February 9 communication report which noted the potential for rutting from the use of a temporary access road (TAR) 53.6 that did not yet have a RCE installed. During the follow-up inspection the CM observed a No Project Access sign installed to prevent travel and the potential for rutting. 2/14/18 CS No The CM observed excessive offsite tracking onto Highway 644 from the CS-1 site in\ the morning. The CM informed the Lead EI of the concerns. The highway was being cleaned of offsite tracking by noon the same day. The CM noted that offsite tracking has been a continuing concern by both the CM and Lead EI. The CM communicated to the Lead EI that additional measures would be needed to prevent continued occurrences of the issue. 2/14/ No The CM observed heavy equipment tracks on the edge of the graded, windrowed topsoil pile. The CM communicated the concerns to the EI. The EI stated the equipment operator was addressed for correction and explained to the operator that driving on topsoil in this manner was not a correct action to prevent further reoccurrence. 2/15/ No The CM observed safety fencing installed on the south side of the additional temporary workspace (ATWS) slightly east of Hametown Rd. The CM noted the safety fence may not have been installed robustly enough to prevent tearing and falling over. The CM communicated the concerns to the Lead EI. 2

The silt fence full of water/sediment and required cleaning out. Two inches of rain was recorded during the rain event the previous evening. The CM informed the Lead EI of the concerns. The Lead EI would discuss the concerns with the Lead EI. The CM would follow-up to document resolution. 2/17/ No The CM noted topsoil was recently backfilled in wetland E Wetland E was erroneously graded on November 25. The CM noted a concern questioning if the correct amount of topsoil was replaced in the previously disturbed wetland area as noted by what appeared to be a significant volume of topsoil in the previously segregated topsoil pile designated for this wetland. The CM communicated with the Lead EI and was referred to the area EI. The EI would communicate with the Contractor. The CM was informed that topsoil may remain until the time of restoration for further spreading. 3

4 SUMMARY OF LEVEL 1, 2, AND 3 VARIANCE REQUESTS Two Level 1 Variance Requests and three Level 2 Variance Requests were approved during this period. A tabular summary of the requested and approved variances for the above-mentioned reporting period is presented below. Variance Number SUMMARY OF APPROVED VARIANCES FOR THE NEXUS GAS TRANSMISSION PROJECT FEBRUARY 12, 2018 THROUGH FEBRUARY 18 Variance Level a Date Received Location (Milepost) Description L1-SP /13/ Request for placement of a hose running from horizontal directional drill (HDD) exit location workspace off right-of-way (within environmental survey corridor) to a Project approved access road. The hose would run across an open field or parking area. L2-SP2-004-ATWS 2 2/7/18 Wareyard 2-2 Request for an additional 0.26-acre workspace at Wareyard 2-2 to be used as an emergency muster & parking area for Project staff. The parking would be used in its current condition (like-use) as an asphalt covered parking lot. L2-SP4-014-ATWS 2 2/15/ Request for additional temporary workspace to assist the local utility authority in repairing a broken water line. The workspace was approximately 10 feet wide by 25 feet long. A portion of that workspace extended into the existing road surface. The water line break was related to the construction of the NEXUS project. The local utility authority required assistance from the Project Contactor to make a timely repair to the water line. The Contractor would excavate the buried water line to assist with the repair. L1-SP /15/ Request for the placement of a pump, hose, and sandbags in a shallow ditch on the adjacent landowner railroad property to dam water that was flooding a railroad track. The water would be pumped away from the flooded tracks onto the other side of the dam into a ditch. Use of a paved railroad yard driveway was also requested to transport the equipment. L2-SP2-005-ATWS 2 2/16/ Request for a acre expansion of the existing workspace at the entrance of TAR 53.6 at Gates Road (CR 209). The road approach end of the workspace did not extend across the width of the existing road approach. The variance was requested to avoid any instances of off right-of-way activity from vehicles entering or exiting TAR Status (Approval Date) 2/13/18 2/13/18 2/15/18 2/15/18 2/16/18 a Variance Level Definitions Level 1 Variance reviewed and approved or denied by the Compliance Monitors. These requests must be within the approved workspace or of like use and are for site-specific, minor, performance-based changes to Project specifications or mitigation measures that provide equal or better protection to environmental resources. Level 2 Variance reviewed and approved or denied by the Compliance Manager. These requests involve Project changes that would affect an area outside of the previously approved work area, but within the corridor previously surveyed for cultural resources, sensitive species, sensitive resources, etc. Level 3 Variance must be reviewed and approved or denied by the FERC Project Manager. These requests exceed the decision authority of the Compliance Manager or are denied as Level 2 Variances. 4
