4 RTKC- East Abutment Extension November 15, Purpose and Need In 2008, RTKC began developing alternatives to expand the existing North Tailings Impoundment to achieve safe and sufficient storage of the projected volume of tailings to be generated according to the mine plan. The full expansion plans (named the Tailings Expansion Project or TEP) required the analysis of several alternatives for the projected tailings storage needs. The desired alternative was the utilization of RTKC property adjacent to the eastern side of the current Tailings Impoundment and south of Interstate 80. This option was projected to encroach upon approximately 700 acres of aquatic resources in the area. While the plans for the TEP were suspended, RTKC continued to evaluate options for completing the North Tailings Impoundment to its permitted design height. The site characterization work for the TEP included, for example, deposition history, hydrology, seismic information, an approved jurisdictional determination, field investigations and material characterization. Some of this information has been essential for the NIC project and for the East Abutment Extension. This application only covers the East Abutment Extension which would tie into the North Tailings Impoundment East Abutment and is necessary to comply with State Engineer seismic regulations. The East Abutment Extension is designed (and extends as far east as proposed) to achieve the desired slope; it will also accommodate certain infrastructure (such as roads and pipelines) needed to support the NIC project. The East Abutment Extension design is the only design option that will meet current State Engineer stability requirements. This application seeks authorization to discharge fill material in a localized area of wetlands and nonwetland waters of the U.S. in order to be able to construct the East Abutment Extension. 4. Project Description RTKC has been evaluating options for ensuring it has adequate tailings storage capacity to accommodate ongoing mining operations. The NIC project is integral to that effort; the NIC allows RTKC to utilize the North Tailings Impoundment to its originally permitted design height of 4462 feet. The NIC will be constructed along the southern side of the North Tailings Impoundment and is not located in any waters (See Figure 3). The proposed East Abutment Extension is the only project that will impact waters. As indicated, the East Abutment Extension will encroach upon certain wetland and non-wetland waters of the US as confirmed by an approved USACE jurisdictional determination. (Supplemental #2 to SPK UO - Attached as Appendix B). The East Abutment Extension is needed to buttress the portion of the East Slope of the South Tailings Impoundment impacted by the NIC project construction. Figure 3 shows the engineering overview of the NIC project and the limited disturbance and impacts to the wetlands associated with the East Abutment Extension, and Figure 4 shows a detailed overview of the East Abutment Extension. The NIC project (including the East Abutment Extension for which this application is being submitted) has been accepted as designed by the State Engineer as shown in Appendix C. There are a few parcels approximately 0.1 mile to the south and east of the project that belong to Waste Control Management as part of the county landfill. There is also one parcel that belongs to Alan Parsons that is also within the landfill area. Figure 3 shows the location and the parcel identification numbers (per Salt Lake County) of adjacent parcels. 9 RTKC- East Abutment Extension November 15, Impacted Wetlands and Non-Wetland Waters The wetlands and non-wetland waters to be impacted by the East Abutment Extension were delineated as part of SPK UO. The wetlands are adjacent to the C-7 Ditch - a Relatively Permanent Water (RPW) and are at a similar elevation to the valley floor. (See Figure 7). WP-NRC submitted information relative to the sources of water and other details related to the wetlands and non-wetland waters in the area in a September 14, 2011 letter to the USACE (submitted on behalf of RTKC). It was explained that the sources of water between the Sedimentation Pond and the C-7 Ditch primarily resulted from surfacing groundwater and direct precipitation that is bound to the east by the C-7 Ditch wall and to the west by the sedimentation pond containment walls. Further, the entire area has an upward hydraulic gradient associated with the Oquirrh Mountains and the additional weight of the tailings impoundment and other manmade landforms just east of the area have likely caused upwelling of groundwater in the region due to associated hydraulic pressure. Water migrates upward through historic stream deposits of coarse material and pools in the region and other areas between this area and south to Highway 201. Additionally, groundwater levels in the historic C-7 Ditch alignment area fluctuate seasonally, the fluctuation is documented by RTKC s monitoring wells located in close proximity to the sedimentation pond. Those wells have recorded high artesian flow during the spring runoff season and a gradual waning of flows through the summer and into the fall and early winter months. The wetlands consist of 1.21 acres of low quality emergent marsh due to the area being dominated by common reed (Phragmites australis). The non-wetland waters consist of 0.36 acre of shallowly ponded waters. Figures 7, 8 and 9 show cross sections of original grade and final grade of the East Abutment Extension (which includes the proposed Lower Access Road). WP NATURAL RESOURCE CONSULTING, INC. 12
