Followig our successful Dever meetig so graciously hosted by David Reitz ad his fie staff, the associatio has take a giat leap forward i ehacig our relatioships with other orgaizatios, thus creatig a greater awareess of our associatio ad what we represet. We have partered with the Pacific Istitute for Research ad Evaluatio (PIRE) i Calverto, Marylad. Pacific Istitute is oe of the atio s preemiet idepedet, oprofit orgaizatios mergig scietific kowledge ad prove practice to create solutios that improve the health, safety ad well-beig of idividuals, commuities, atios ad the world. This relatioship with Bob Reyolds, Johetta Davis ad their dedicated staff at PIRE has resulted i several excitig thigs to NLLEA. NLLEA, with the help of PIRE, has established a permaet atioal office i Calverto, Marylad, a suburb of Washigto DC. Housed i PIRE s hadsome headquarters, this gives NLLEA a permaet atioal office with support fuctios. Aother excitig ews item is that NLLEA, assisted by PIRE, has bee awarded a $200,000 work order from the Natioal Highway Traffic Safety Admiistratio (NHTSA) with two objectives. The first objective is to idetify, orgaize, sythesize, promote ad distribute the research ad practical kowledge of the Natioal Liquor Law Eforcemet Associatio to atioal, state, provicial, regioal, ad local law eforcemet persoel ad orgaizatios. The secod objective is to assemble best practice eforcemet strategies, develop a ivetory of state alcohol laws ad violatio pealties, ad establish traiig stadards ad performace measures i order to motivate, ecourage ad ehace local commuity eforcemet of alcohol laws ad regulatios. NHTSA officials Sue Rya ad Jim Wright have really show their support to NLLEA o this project ad its award, ad we sicerely appreciate their efforts. PIRE has appoited Jim Fell, formerly with NHTSA, to head up the project for NLLEA ad PIRE. Jim has bee workig very hard to put the fiishig touches o the tasks that will eed to be accomplished ad is i cotact with me several times a week to discuss those issues. Aother importat ew partership is with the U.S. Departmet of Justice, Office of Juveile Justice ad Deliquecy Prevetio (OJJDP). The work that OJJDP does to reduce youth access to alcohol ad eforce uderage drikig laws is aliged with our work, ad Bob Hubbard, from the OJJDP, has prove to be a big supporter of the NLLEA. OJJDP has agreed through its 1

As a cosequece, Jim was asked to orgaize a workshop o liquor law eforcemet at the 108th Aual Coferece of the IACP i Toroto, Caada i October ad to give a presetatio o NLLEA at the MADD Natioal Coferece i Dallas, Texas i September. There are may more cofereces ad meetigs to be held i the remaiig moths of 2001 ad ito 2002 where NLLEA has bee asked to participate either i workshops or formal presetatios o our associatio. I am proud to aouce that aother successful NLLEA Natioal Traiig Academy was held i April. North Carolia s Alcohol Law Eforcemet Divisio, uder the leadership of Director Joh Smith III, hosted the academy agai this year. NLLEA Natioal Traiig Coordiator, Chuck Coklig, ad his staff did a excellet job as usual with the academy. I attedace were 46 studets represetig 17 states. West Virgiia gets the Greatest Number Atteded Award with the West Virgiia ABC sedig 11 of their staff icludig their ew Eforcemet Director, David Platz, ad Deputy Commissioer, Keith Wager. The iterview will cover a variety of topics that pertai to the eforcemet of liquor laws, but the mai focus will be o laws ad pealties ad best practice eforcemet strategies that relate to sales ad service to miors ad obviously itoxicated idividuals. Rebecca Ramirez, from PIRE, will be cotactig you over the ext few moths to arrage a time to complete the telephoe iterview. Although the iterview may be somewhat time cosumig, please set aside some time to speak with Rebecca. The iformatio you provide will be ivaluable i establishig best practice strategies throughout North America ad will help idetify stregths ad weakesses i liquor laws ad pealties. Hot Issues New Brach i the Ketucky ABC Commissioer Johstoe of Ketucky has created a Educatio Brach that is close to beig fully staffed. The Brach is already teachig a alcohol server awareess program called S.T.A.R. (Server s Traiig of Alcohol Regulatios). The Educatio Brach is also workig with the Eforcemet Divisio to create a lesso pla for law eforcemet officers that will be taught by Eforcemet Ivestigators who are Ketucky Law Eforcemet Coucil certified. 3

4 The Ketucky State Police have expressed a iterest i icludig this traiig i the basic academy traiig curriculum, ad the traiig will be icluded i the Basic Traiig Academy i Richmod as well. The class will be available to all law eforcemet agecies i the state. Cosideratio will be give to icludig this type of traiig at the NLLEA Traiig Academy as appropriate. Budget Cuts i North Carolia North Carolia is facig a billio dollar shortfall this year, ad budget cuts are hittig the North Carolia Alcohol Law Eforcemet Divisio. Though the state s budget has ot bee fialized, the ALE faces more tha a half millio dollars i cuts. ALE is strugglig to prevet cuts to ALE Supervisor ad Assistat Supervisor positios. If ayoe has sample letters or strategies to justify the cotiuatio of liquor law eforcemet agecies to legislators, please sed or them to Bill Patterso. New Liceses i Ketucky The Ketucky Alcoholic Beverage Cotrol Eforcemet Divisio is busy tryig to keep up with the ever-chagig ABC laws. Durig the 2001 legislative sessio the Ketucky Legislature created two ew types of liquor liceses. The ewly created Golf Course Licese allows golf courses that are located i a moist couty (a couty that has alcohol sales i part of its boudaries) to have a precict electio to allow alcohol sales at specified golf courses. So far, four of these liceses have bee issued. The law is uclear as to whether Suday sales are allowed, ad the Divisio expects that ew legislatio will be eeded to address this issue. A secod type of licese that has bee created is the Restaurat Drik Licese. This licese ca be obtaied by a majority vote i a particular city or precict i a dry territory. A requiremet of this licese is that the restaurat must have sevety percet of their sales come from food purchases. Although the Divisio believes that large frachised restaurats will ot have a problem meetig this requiremet, there is cocer that other restaurats may use this licese illegally. Curretly, six previously dry areas have approved these types of liceses, ad ivestigators are ow required to cover areas that they did ot have to cover before as part of their routie duties. Policy Highlights Georgia Durig the 2001 legislative sessio, the Georgia Geeral Assembly passed Keg Registratio legislatio. The legislatio calls for the Divisio to issue tags or labels ad forms to retailers statewide who sell kegs. The ew law requires the seller to complete the form requestig his/her licese umber, ame, address, the date of sale ad the form of idetificatio used by the purchaser. The ew law requires the purchaser to sig a statemet regardig the accuracy of the purchaser s ame ad address ad the locatio where the cotets of the keg will be cosumed. I additio, the purchaser ackowledges that misuse of the keg may result i crimial prosecutio, crimial liability or both, if the cotets of the keg are made available to uderage persos, or if the tag or label of the keg is removed. The registratio umber is recorded o the tag/label ad the registratio form at the time of the sale. Oklahoma The Oklahoma 2001 legislative sessio produced several major chages to liquor eforcemet statutes. Begiig November 1, 2001, idetificatio stamps that are curretly required to be affixed o each bottle of liquor or case of strog beer sold by a wholesaler to a mixed beverage, caterer, or mixed beverage/caterer combiatio licesee will o loger be required. It is aticipated that this ew statute will icrease the difficulty of trackig alcoholic beverages illegally purchased by licesees through either retail liquor stores or out of state purchases. O a positive ote, after several previous failures, the legislature passed a bill lowerig Oklahoma s legal BAC limit from 0.10% to 0.08%, effective Jue 8, The ew stadard places Oklahoma i compliace with Federal law ad provides substatial icetive grat fuds to the State. 4

Highlights of the coferece icluded semiars o Coductig Sale to Miors Compliace Checks, Developig a Tobacco Eforcemet Program, Iteret Eforcemet Issues, Public ad Press Relatios, ad that uforgettable semiar All You Wated to Kow About Strip Clubs, But Were Afraid to Ask. The coferece was a excitig week of iformatio exchages, cultural exploratio (dier trip to Blackhawk), ad true Wester style hospitality agaist the backdrop of the Rocky Moutais. Agai, thak you to David Reitz ad the Colorado Liquor Eforcemet staff for such a successful coferece. 6th Aual NLLEA Traiig Academy The 6th aual traiig academy was coducted April 22-27, 2001 i Wilmigto, North Carolia. As usual, the academy was comprised of three phases. Phases I ad II had sixtee studets each. Phase III had fourtee studets. I additio to the academy coursework, the New Haover Couty Law Eforcemet Officer s Associatio sposored a Bar-B-Q for the academy studets ad staff. Aother added attractio was a private tour of the Battleship USS North Carolia. NHTSA estimates that these laws save almost 1,000 lives a year. However, the federal law did ot require compliace just a law o the books. As a result, the level of eforcemet is very ueve throughout the coutry. There are may factors that create this ueve eforcemet icludig disparities i resources, lack of commitmet to this issue amog eforcemet leaders, weakesses i the laws ad alcohol beverage cotrol systems, ad lack of traiig. NHTSA supports the efforts of the Natioal Liquor Law Eforcemet Associatio (NLLEA) ad recetly awarded fudig to expad these efforts. The NLLEA has addressed may of the factors that create reduced eforcemet of beverage cotrol laws ad is i the uique positio to do much more. With NHTSA fudig support it is expected that the NLLEA will become a key orgaizatio i reducig the coectio betwee alcohol ad crime, particularly the crime of impaired drivig. The NHTSA/NLLEA partership will result i icreased ad improved traiig for local eforcemet agecies, improved iformatio about the critical issues surroudig alcohol beverage cotrol, ad expaded parterships with other law eforcemet agecies at the atioal, state ad local levels. 6 Key Gavi, U.S. Drug Eforcemet Agecy Cheryl Leoard, North Carolia Goveror s Highway Safety Program Law Corer Age 21 Drikig Laws Uder Attack By Aida Moore Like the rhythm of a beatig drum, oppoets of the age 21 drikig laws are gatherig mometum i a effort to lower the lawful age of alcohol cosumptio from 21 to 18 or 19. While atagoists suggest the age 21 drikig laws are outdated ad discrimiatory, propoets ca draw upo statistical data showig the effectiveess of the drikig age i reducig the umber of alcohol related fatalities for the uder 21 age group. For a log time, the legal age for purchasig alcohol was 21 years old i most of the Uited States. The, i the 1960s ad early 1970s, may states lowered their miimum purchasig ages to 18 or 19 years old. Research o the cosequeces of this actio idicated a icrease i the umber of drivers youger tha 21 ivolved i ighttime fatal crashes. As a result of this ad other studies with similar fidigs, a umber of states raised their miimum alcohol purchasig ages i some states back to 21 years old ad i other states to 19 or 20. The Isurace Istitute for Highway Safety (IIHS) evaluated this developmet i ie states i 1981, fidig reductios i ighttime fatal crashes amog youg drivers. The average fatality reductio based o all ie states was 28 percet. A subsequet study by NHTSA i 26 states that raised miimum legal alcohol purchasig ages durig estimated a 13 percet reductio i ighttime driver fatal crash ivolvemet. I 1984, 23 states had miimum alcohol purchasig ages of 21 years old, ad federal legislatio was eacted to withhold highway fuds from the remaiig 27 states if they did ot follow suit. Sice July 1988, all 50 states ad the District of Columbia have required alcohol purchasers to be 21 years old. May people uder the age 21support a reductio i the drikig age. The debate was fueled by the recet police actio take agaist Jea ad Barbara Bush i Austi, Texas. But the ews is gettig shrugs - ad eve laughs - from a umber of college studets who woder why it s a big deal if a 19-year-old wats a margarita. Agela Quiram says Jea ad Barbara Bush are simply doig what college studets do. It s a rite of passage, Quiram, a recet graduate of the Uiversity of Wiscosi- Madiso, said as she sat with frieds at a Chicago bar frequeted by college studets. Quiram marked her ow passage ito the adult world of drikig with the $212 ticket she got two years ago, at age 20, for drikig o campus. 1 But the uder 21 group is ot aloe. Some members of the higher educatio commuity seem ot oly willig to etertai the cocept of a drikig age reductio, but also advocate that colleges step i ad accept the otio that college age kids drik ad that we should teach them to do it resposibly. But data suggests delayig the oset of alcohol cosumptio i youg people has a dramatic effect. Accordig to Dr. Hoover Adger, professor ad pediatricia at Johs Hopkis Uiversity i Baltimore, Md., childre who start drikig before age 15 are five times more likely to be alcohol depedet as adults, te times likelier to be ivolved i a fight after cosumig alcohol, seve times likelier to be ivolved i car accidets ad twelve times likelier to be ijured. Nevertheless, there are also youg people who support the curret laws - ad who fear that lowerig the drikig age would oly lead to more deaths. Already, alcohol is a factor i a third of tee car crash deaths atiowide. Meaga Gaither, a member of Mothers Agaist Druk Drivig Youth i Actio, helped federal officials pla a coferece i Los Ageles i July aimed at lowerig the umber of tees who die i car crashes. 7 Law eforcemet professioals who eforce beverage alcohol laws have always foud themselves with a uphill battle. With too little staff, resources ad support, a difficult job has bee made more difficult as the debate heats up o age 21. As NLLEA members, we must cotiue to move to the frot of the pack as the correlatio betwee social behavior ad aggressive liquor law eforcemet is debated. We eed to parter with other law eforcemet groups, health ad prevetio advocates ad youth to beat back the surge ad emphasize the obvious beefits of age 21. Techology News New Bulletproof Vests i Oklahoma The ABLE Commissio is participatig i the Bulletproof Vest Partership Program fuded through the Departmet of Justice. This program pays for as much as 50% of the costs of buyig, fittig ad shippig approved types of bulletproof vests for law eforcemet officers. The Agecy s applicatio was approved, ad the vests have bee ordered through a authorized vedor. This program allows the Agecy to replace existig vests after usig them for seve years. Updated Equipmet i Ketucky This year the Eforcemet Divisio provided all ivestigators with updated computers, priters ad fax machies. The Divisio also replaced the wor out Prelimiary Breath Testers ad furished ivestigators with surveillace tape recorders (Pearl Corder) for evidetiary purposes used routiely o Ivestigative Aide ivestigatios (Operatio Zero Tolerace). The icar police radios were removed from the vehicles ad everyoe was issued ew had held radios. I additio, ivestigators were issued cell phoes. Surveillace Vas i North Carolia A grat from the Goverors Highway Safety Program fuded two fully equipped surveillace vas to be used i a covert capacity to target locatios that may be sellig alcohol to uderage ad itoxicated persos. By workig with programs such as Booze It ad Lose It ad Cops i Shops across North Carolia, the Alcohol Law Eforcemet Divisio is targetig druk drivers at the source-before they get out o the road. Passive Alcohol Sesors Passive Alcohol Sesors (PAS) are becomig more widely used by law eforcemet ad school officials to passively detect alcohol o uderage persos or those suspected of drikig ad drivig. I the form of a flashlight, clipboard, or had held calculator, the PAS has a electrochemical fuel cell built ito it which geerates a voltage i respose to alcohol vapor. As the subject speaks for about 4 secods, a small powerful pump iside the sesor draws through the fuel cell a sample of the subject s exhaled breath. 8 Historical Iformatio The History of the NLLEA The idea for a atioal orgaizatio represetig alcohol eforcemet agecies i North America was bor i North Carolia i The Director of the North Carolia Alcohol Law Eforcemet Divisio at that time was Doald M. Murray who had the idea of brigig maagers of State/Provicial Alcohol Law Eforcemet orgaizatios together aually to share ideas ad exchage iformatio related to professioal eforcemet of alcohol laws ad regulatios. The first meetig was held durig the summer of 1987 i Souther Pies, North Carolia. Represetatives atteded that first meetig from agecies i Motgomery Couty, Marylad, Washigto, Orego, Maie, Virgiia, Pesylvaia, Ohio, Michiga, Mississippi ad North Carolia. From that origial meetig i North Carolia there was ethusiastic support to cotiue the meetigs o a aual basis at differet locatios aroud North America. I 1988, Joh Marti, the Director of Eforcemet for the Maie Bureau of Liquor Eforcemet, hosted our ext coferece i Rockport, Maie. From that coferece, the Natioal Liquor Law Eforcemet Associatio was bor ad officially chartered i Maie with Joh Marti as our first Presidet. Sice 1988 the Natioal Liquor Law Eforcemet Associatio has grow to over 115 members represetig some 37 states, 4 couties, 4 cities, 1 Idia Reservatio, 1 uiversity ad 2 Caadia provices i North America dedicated to the highest ethical stadards of professioalism i liquor law eforcemet today.
