1 N /22/03 EEAC 2003 Fall Membership Meeting Detailed Agenda and Registration Information October 8-10, 2003 The Drake Hotel Chicago, IL Attached for your information are detailed program and registration information for EEAC s Fall Meeting, which will be held at The Drake Hotel in Chicago, IL on Wednesday through Friday, October Dress for the Fall Meeting is business casual and Friday will be our traditional company logo day. A registration form is attached, or you may register on-line on EEAC s website at Meeting highlights include: Pre-Meeting Comp Auditor Users Group meeting on Wednesday afternoon, followed by a Welcoming Beer-Wine Reception that evening sponsored by EEAC member company ConAgra Foods. Thursday morning keynote presentation by civil rights pioneer Morris Dees, founder and chief trial counsel of the Southern Poverty Law Center, followed by an EEAC Staff Update covering the latest EEO/AA compliance developments. Thursday s luncheon speaker is Kevin Powell, a leading voice of Generation X. Three concurrent Workshops on Thursday afternoon: (1) OFCCP Enforcement Trends; (2) Constructing a High-Level Representational Component for Your Diversity Scorecard; and (3) Avoiding the Recoil: Preventing Retaliation Claims, followed by an evening reception for attendees and guests hosted by member company Aon Corporation. Special presentations on Friday morning by Maureen Sullivan, author of The Gen X ers Guide to Boomerangers, and by EEOC Vice Chair Naomi C. 2 EEAC S 2003 FALL MEMBERSHIP MEETING AGENDA WEDNESDAY, OCTOBER 8, 2003 Comp Auditor 5.0 Users Group Meeting (2:00 p.m. 5:00 p.m., Room TBA) EEAC s Comp Auditor 5.0, which was upgraded late last year, is a unique software program designed to assist a member company in conducting a self-audit of its employee compensation practices for potential pay discrimination. This session will provide an opportunity for current and prospective users to view the enhanced features of Comp Auditor 5.0, as well as learn more about how it can assist a company in conducting a compensation analysis. Early Meeting Registration (4:30 p.m. 5:30 p.m.) Welcoming Beer-Wine Reception Hosted by ConAgra Foods (5:30 p.m. 7:00 p.m., Room TBA) The Welcoming Beer-Wine Reception provides attendees arriving for the meeting the opportunity to get together in an informal setting to say hello to old friends and colleagues and to meet new ones. This year s Fall Meeting Welcoming Reception is sponsored by EEAC member ConAgra Foods. ***** THURSDAY, OCTOBER 9, 2003 Meeting Registration (7:30 a.m. 9:00 a.m.) Prospective Member and First-Time Attendee Orientation (8:00 a.m. 8:30 a.m., Room TBA) This session is geared to member company representatives and prospective members that are attending their first EEAC meeting, although all attendees are welcome. We use this opportunity to tell you about the wide array of services that EEAC offers to its member companies, introduce you to EEAC s staff experts, preview our training programs, and walk you through the annual meeting program. If you are attending your first EEAC meeting, we ask that you check the box indicating first-time attendance in the space provided on the attached registration form.
3 -2- Plenary Session (8:45 a.m. 12:00 noon, Room TBA) Thursday morning s plenary session will commence with a keynote address by Morris Dees, a civil rights pioneer and founder and chief trial counsel of the Southern Poverty Law Center. Located in Montgomery, Alabama, the Center began as a small civil rights law firm in 1971 and now is internationally known for its legal victories in defense of civil rights. Mr. Dees remarks will be followed by our traditional EEAC Staff Update, where EEAC s staff experts will give their perspectives on the most recent developments concerning the proposed changes to the EEO-1 form, applicant guidance, OFCCP s compensation analysis methodology, EEOC enforcement trends, and other current topics of interest to attendees. There will be plenty of time for Q&A. Luncheon (12:00 noon 1:30 p.m., Room TBA) Kevin Powell, Leading Voice of Generation X Kevin Powell has been hailed as one of the most important voices of Generation X, speaking out on a wide-range of subjects including racism, sexism, multiculturalism, Black and American history, and Martin Luther King, Jr. A poet, journalist, essayist, public speaker, hiphop historian, political activist and TV, radio and Internet commentator, Powell is perhaps best known for his stint as a cast member on the first season of MTV s hugely successful series The Real World (New York City). A prolific writer, Powell s articles, essays and reviews have appeared in a range of publications like Newsweek, Code, Essence, The Washington Post and Vibe, where he worked as a senior writer for several years. Concurrent Workshops (1:45 p.m. 3:15 p.m.; repeated 3:30 p.m. 5:00 p.m., Rooms TBA) Workshop 1: OFCCP Enforcement Trends OFCCP has embarked on a new enforcement strategy that, among other things, contemplates a significant increase in the number of compliance evaluations and seeks to identify potential systemic discrimination at the initial desk audit stage of the evaluation. The new strategy also calls for early closure of routine evaluations, and full attorney-guided investigations for evaluations indicating possible systemic discrimination. OFCCP Deputy Director Bill Doyle will provide workshop participants with a National Office perspective on the agency s new enforcement approach. Mr. Doyle will be joined by Midwest Regional Director Sandra Ziegler, who will share how that approach is actually being implemented in one of OFCCP s Regions. EEAC s Rae Vann will moderate the workshop.
4 -3- Workshop 2: Constructing a High-Level Representational Component for Your Diversity Scorecard This workshop will feature an EEAC member company panel discussion on using representation-based diversity metrics to foster diversity at senior levels with an organization. Leading companies today utilize a variety of programs and processes (e.g., recruitment, evaluation, development, succession planning) to drive diversity at director-level and above positions. This workshop will focus on how such companies measure the impact of these programs in promoting diverse senior management and how they incorporate such measurements in their diversity scorecards. EEAC s Nancy Nelkin will moderate the workshop. The panel will include Keith Borders, Senior Director, Associate Relations, Luxottica Retail. Workshop 3: Avoiding the Recoil: Preventing Retaliation Claims Doing the right thing the wrong way can have serious consequences. A company that takes prompt and appropriate adverse action against a sexual harasser, for example, may find itself facing a charge from the harasser himself of retaliation for his participation in an investigation or lawsuit arising out of the internal complaint against him! During the last fiscal year, a full 27% of charges filed with the Equal Employment Opportunity Commission were allegations of retaliation. In many cases, the underlying discrimination charge yielded a nocause finding, but the agency found cause on the retaliation claim. Managing employees who have filed charges can be touchy, and doing it well is an acquired skill. This workshop will feature a panel of EEAC member company representatives who will discuss strategies for avoiding retaliation claims. The panel will include Stephanie Bradley, Vice President, Employee Relations & Assistant General Counsel, Baxter International, Inc. and Susan Rosborough, Counsel, Allstate Insurance Company. EEAC s Ann Reesman will moderate. Reception Hosted by Aon Corporation for All Meeting Attendees (5:30 p.m. 7:00 p.m., Room TBA) The Thursday evening reception provides another opportunity for attendees to get together in an informal setting to review the day s events and chat with old and new friends. The reception will be hosted by EEAC member Aon Corporation.
5 -4- ***** FRIDAY, OCTOBER 10, 2003 Committee Meetings (8:00 a.m. 8:45 a.m., Rooms TBA) EEAC has three standing committees, which are open to participation by any member company representative attending the fall meeting. The Case Selection Committee monitors and analyzes pending EEO litigation and recommends cases for EEAC amicus curiae brief participation; the EEO/AA Compliance Committee analyzes proposed agency regulations and assists EEAC staff in the preparation of written comments; and the Member Enrichment Committee provides a forum where members work with EEAC staff in recommending program and service enhancements designed to retain current members and attract new members. These are hands-on sessions, and attendees are encouraged to actively participate. General Session (9:00 a.m. 12:00 noon, Room TBA) On Friday morning, there will be a special presentation by Maureen Sullivan, author of The Gen X ers Guide to Boomerangers, focusing on the effects on the workforce and workplace when baby boomers retire and then return to work. Ms Sullivan s remarks will be followed by a keynote presentation by Equal Employment Opportunity Commission Vice Chair Naomi C. Earp, who was appointed to the EEOC by President Bush earlier this year. Vice Chair Earp served as a staff attorney at the EEOC in the late 1980 s, and has held several EEO-related positions within the federal government since then. She will give her unique perspectives as the newest EEOC Commissioner. Buffet Lunch (12:00 noon 1:00 p.m., Room TBA) Roundtables (1:15 p.m. 3:00 p.m., Rooms TBA) The meeting will close with three informal roundtables: EEO/AA Compliance, Diversity and Legal Issues. These free-flowing, off-the-record sessions are open to all meeting attendees and are specifically designed to encourage the candid exchange of company experiences.

Pre-registration and pre-payment are encouraged. For registrations received and paid on or before October 1, the fee is $350. For registrations received and paid between October 2-10, the fee is $375. The fee for payments received after the meeting is $400. Hotel Accommodations A block of rooms is being held by The Drake Hotel for EEAC meeting attendees until September 7, These rooms are available to EEAC members at a discounted rate of $199 for a single or double room. After September 7, rooms will be available on a first come, first served basis at regular rates. To make your hotel reservation, you must call the hotel directly at Please remember that in order to acquire the discounted room rate, you must indicate that you are attending the EEAC Fall Meeting. Cancellation Policy Full refunds will be made for cancellations received by EEAC before October 3, For cancellations received by EEAC on or after October 3, 50% of the registration fee will be refunded. Refunds will be processed for cancellations received by mail or fax only. Failure to notify EEAC of a cancellation in writing prior to the program may result in no portion of the registration fee being refunded. Use of Recording Devices Because the meeting sessions are designed to encourage attendees to be candid in their questions and comments, the use of audio and/or video recording devices is not permitted. In addition, discussions during the sessions are off-the-record and not for attribution to any particular individual or company.
