Eastern Washingtn University is cmmitted t prviding a safe and healthy envirnment fr its emplyees, students and visitrs. In light f the assciated health risks, the use f tbacc, electrnic cigarettes, and related prducts in r n university wned r leased prperty is restricted as described herein. (1) The use f tbacc, electrnic cigarettes, and related prducts is prhibited: (a) Within any building r vehicle wned r leased by EWU, t include residence halls and university apartments; and (b) Within twenty-five feet f entrances, exits, windws that pen, and ventilatin intakes f any building wned, leased, r perated by EWU. (2) Fr the purpses f this sectin, "tbacc, electrnic cigarettes, and related prducts" includes any cigarette, cigar, pipe, bidi, clve cigarette, e- cigarette/cigar/pipe, waterpipe (hkah) and smkeless r spit tbacc, disslvable tbacc, snuff r snse. (3) Distributin r sale f tbacc, electrnic cigarettes, r related prducts in r n EWU wned r leased prperty is prhibited. Advertising r spnsrship f tbacc, electrnic cigarettes r related prducts is prhibited n EWU prperty r at University-affiliated events, including the use f brand r crprate names, trademarks, lgs, symbls r mtts. EWU will neither slicit nr accept any grant r gift frm a manufacturer, distributr r retailer whse principal business is tbacc, electrnic cigarettes, r related prducts. (4) Any persn intentinally vilating this sectin may be subject t a civil fine f up t ne hundred dllars. Lcal law enfrcement agencies may enfrce this sectin by issuing a ntice f infractin, assessed in the same manner as traffic infractins, as described under chapter RCW. WSR , , filed 3/26/12, effective 4/26/12.] Why is this Plicy Needed? Students, staff and faculty supprt a tbacc free plicy. Tw surveys have been cmpleted n campus which asked students, staff and faculty fr their pinins n a smke free campus. The first was cnducted in 2013 and included results frm students, staff and faculty. Results are as fllws: This analysis cmbines the respnses f 538 staff and faculty and 1408 and was administered during February and March Only 13% percent f all respndents were active smkers (9% faculty/staff and 14% students). Eighty five percent reprted being very annyed r smewhat annyed by secndhand smke (90% staff and 84% students) and 90% believe that it is harmful. 3 smke- r tbacc-free campus. There were 1017 vtes cast in this general electin. The questins asked were: Questin #1: Des secndhand smke n campus bther yu? a. Yes 768 (76%) b. N (24%) Questin #2: Have yu ever experienced any immediate negative health effects frm secndhand smke n campus (i.e. cughing, wheezing, asthma attack, r allergic reactin)? 1. Yes (59%) 2. N (41%) Questin #3: Wuld yu supprt a tbacc/smke free plicy at EWU? 1. Yes, tbacc free/smke free (82%) 2. N. 185 (18%) The plicy enhances the cleanliness and safety f campus. Eastern Washingtn University s Custdial Manager and Landscape Maintenance Supervisr were interviewed. Bth f these university emplyees pinted ut the harmful and aesthetically devastating effects smking and tbacc prducts have n the campus envirnment. They als mentined the extra hurs f labr needed t clean up cigarette butts, clean ut smking receptacles, and put ut cigarettes that culd cause fires. The Cheney Fire Department als reprted that they are called t campus 2-3 times each year t put ut a cigarette receptacle that is n fire. Belw are phts cllected frm designated smking areas n EWU campus Only a small percentage f the campus cmmunity uses tbacc. The 2016 American Cllege Health Assciatin-Natinal Cllege Health Assessment II (ACHA-NCHA II) administered thrugh Eastern Washingtn University s Health, Wellness and Preventin Services fund that Eastern Washingtn University students reprt current use as fllws: 8.2% f students smked cigarettes 6.1% used e-devices 2.9% smked hkah What will this Plicy Accmplish? This plicy wuld extend cverage f the current plicy (which cvers all indr spaces, as well as 25 feet frm drs, windws and intake systems) t encmpass that entire campus and imprve the health and wellbeing f ur campus cmmunity. Our students that attend classes at EWU Spkane are already prtected frm secndhand smke thrugh a campus plicy

4 implemented by WSU Spkane Health Sciences. Accrding t the U.S. Surgens General s Reprt, tbacc use and smking causes disease and premature death in children and adults wh smke. Additinally, secndhand smke expsure causes death and disease in children and adults wh d nt smke. Being expsed t any level f secndhand smke is unsafe (CDC, NCL, 2015). What existing plicies r status (if any) create the need fr this plicy? Tbacc-free Campus THE WSU SPOKANE CAMPUS IS TOBACCO FREE. The tbacc-free plicy applies t all campus grunds and state-wned vehicles and equipment. The plicy ges beynd the tbacc-free area mandated by the Washingtn Clean Indr Act, which prhibits smking in public buildings as well as within 25 feet f drs, windws, and ventilatin intakes. We have a significant prprtin f ur students that attend classes n this campus, are used t the plicy and are prtected frm secndhand smke. Plicy prpsed by ASWSUS The ASWSU Spkane student senate prpsed the all-campus tbacc-free plicy in April 2011; campus leadership apprved the final plicy in December (See cmplete plicy belw.) The measure was prpsed t be cnsistent with the campus designatin in 2010 by the WSU Bard f Regents as the University s health sciences campus. TOBACCO-FREE CAMPUS POLICY Effective Date: May N Tbacc Use: In rder t create an atmsphere cnsistent with WSU Spkane s visin statement fr a creative, engaged, wrld-class learning enterprise fr the 21st century that helps design healthy lives, institutins and envirnments, WSU Spkane prhibits the use and sale f tbacc prducts in r n the campus. 2. Definitins: Fr the purpses f this plicy, the fllwing wrds and phrases shall mean: Tbacc Prducts: Cigarettes, cigars, pipes, hkah, all frms f smkeless tbacc, electrnic cigarettes, clve cigarettes and ther alternative prducts made primarily with tbacc. Premises: All buildings, grunds, state-wned vehicles and equipment including, but nt limited t, parking lts, bus stps, city wned and WSU maintained streets r sidewalks within the WSU Spkane campus. 3. Resurces: WSU Spkane is cmmitted t assist emplyees, students, patients, visitrs and thers, regardless f institutinal affiliatin. WSUS may make available t such persns resurces intended t assist persns wh use tbacc. 4. Cmmunicatin and Cmpliance: The fllwing persns are respnsible fr ensuring that this plicy is cmmunicated t emplyees, students, visitrs and thers in the WSU Spkane cmmunity: Human Resurces t emplyees Student Affairs regarding students and rm/event scheduling Academic department leads t ther visitrs Cmmunicatins Office t external visitrs Facilities t utside vendrs wrking n campus Chancellr s Office t partner institutins

5 Each f the abve respnsible persns may establish prcedures and prtcls, cnsistent with each ther and this plicy, designed t eliminate tbacc use frm campus, increase cmpliance and t assist tbacc users in availing themselves f tbacc dependency treatment ptins. 5. Sanctins: Effrts will be made t eliminate the need fr sanctins by first infrming emplyees, students and visitrs f the plicy befre they arrive and by prviding apprpriate infrmatin and care while they are n WSU Spkane premises. Any persn wh repeatedly vilates this plicy may be asked t leave the premises and/r may be remved. Emplyees may be subject t crrective r disciplinary actin and ther sanctins available t enfrce this plicy. 6. Signage: Signs declaring WSU Spkane as tbacc-free shall be psted at the campus entries and ther cnspicuus places. 7. Disclsure f Plicy and Infrmatin: All faculty and staff are encuraged t assist in the implementatin and enfrcement f this plicy by making tbacc prduct users aware f the requirements f this plicy. Emplyees, students and visitrs will be advised f this plicy in a manner determined by the abve-described respnsible persns. What will the plicy state? DEFINITIONS: Fr the purpses f this plicy: Smking is defined as the use f smke-prducing tbacc prducts, such as cigarettes, cigars, cigarills, mini-cigars, and hkah. Tbacc use is defined as the use f any tbacc prduct including, but nt limited t cigarettes, cigars, cigarills, mini-cigars, hkah, spit tbacc, snus, and ther smkeless prducts. E-Cigarette use r Vaping is defined by the use f electrnic smking devices r electrnic nictine delivery systems. FDA-apprved cessatin aids, such as nictine patches and gum, are nt included in this categry. POLICY: The use f tbacc (including cigarettes, cigars, pipes, smkeless tbacc, e-cigarettes and all ther tbacc prducts) by students, faculty, staff, guests, visitrs, and cntractrs is prhibited n all prperties wned r leased by campus, including (but nt limited t): All interir space n campus and prperty leased by the university/cllege; All utside prperty r grunds n university campuses, including areas such as walkways, breezeways, parking lts, and patis All utside prperty leased by the university/cllege; All vehicles leased r wned by the university cllege; All indr and utdr athletic facilities.

6 COMPLIANCE: All university emplyees, students, visitrs, guests and cntractrs are required t cmply with this plicy, which shall remain in effect at all times. Refusal t cmply with this plicy may be cause fr disciplinary actin in accrdance with emplyee and student cnduct plicies. Refusal t cmply with the plicy by visitrs, guests and cntractrs may be grunds fr remval frm campus. EXCEPTIONS: The fllwing activities may be cnducted as exceptins t the plicy subject t advance apprval as indicated. 1. The use f tbacc prducts in labratry and classrm instructin/experiments, r fr artistic purpses. All research, educatinal, and/r artistic purpses that invlve the use f tbacc n campus must be apprved in advance by the Prvst r designee. Such use must be preceded by reasnable advance ntice t the public. 2. Specific activities used in cnnectin with the practice f cultural activities by American Indians that are in accrdance with the American Indian Religius Freedm Act, 42 U.S.C. sectins 1996 and 1996a allw fr the use f ceremnial tbacc. All ceremnial use exceptins must be apprved in advance by the Administratin r a designee. What effective date is desired? The ideal date wuld be the start f fall quarter This is a natural fresh start t the academic year and new first year and transfer students wuld be arriving n campus t an updated plicy.
