2 The Drug-Free Schls and Cmmunities Act The Drug-Free Schls and Cmmunities Act (DFSCA) requires that, as a cnditin f receiving funds r any ther frm f financial assistance under any federal prgram, a cllege r university must certify that it has adpted and implemented a prgram t prevent the unlawful pssessin, use, r distributin f illicit drugs and alchl by students and emplyees. In rder t certify its cmpliance with the regulatins, a cllege r university must adpt and implement a drug preventin prgram t prevent the unlawful pssessin, use, r distributin f illicit drugs and alchl by all students and emplyees bth n schl premises and as part f any f its activities. Creating a prgram that cmplies with the regulatins requires a cllege r university t d the fllwing: Prepare a written plicy n alchl and ther drugs. Develp a sund methd fr distributin f the plicy t every student and IHE staff member each year. Prepare a biennial review reprt n the effectiveness f its alchl and ther drug prgrams and the cnsistency f plicy enfrcement. Maintain its biennial review reprt n file s that it can be submitted, if requested by the U.S. Department f Educatin, ther entity r individual. Mnre Cunty Cmmunity Cllege (MCCC) Directr f Human Resurces cnducted a review as required fr the years and A hardcpy f this reprt is available at the Directr f Human Resurces Office and n the Human Resurces website. Cmpliance with the DFSCA Creating a prgram that cmplies with the regulatins requires clleges and universities t d the fllwing: 1. Annually distribute t each student and emplyee (all f these items are addressed in the MCCC Annual Security Reprt als knwn as the Clery Reprt): Standards f cnduct that directly prhibit the unlawful pssessin, use, r distributin f illicit drugs and alchl by students and emplyees bth n schl premises r as part f any f its activities; A descriptin f the applicable legal sanctins under lcal, State, r Federal law fr the unlawful pssessin r distributin f illicit drugs and alchl; A descriptin f the health risks assciated with the use f illicit drugs and the abuse f alchl; and A clear statement that the institutin will impse sanctins n students and emplyees (cnsistent with lcal, State, and Federal law), and a descriptin f thse sanctins, up t and including expulsins r terminatin f emplyment and referral fr prsecutin, fr vilatins f the standards f cnduct. 2. The bjectives f the review as identified by the U.S. Department f Educatin include: Determining the effectiveness f and t implement any needed changes t alchl and ther drug prgrams, and, Ensuring that the disciplinary sanctins fr vilating standards f cnduct are enfrced cnsistently.

3 In additin, the biennial review reprt is maintained n file s that the Cllege can submit it t the U.S. Department f Educatin if requested t d s. As is the case fr many universities and clleges acrss the United States, drug and alchl awareness effrts directed t MCCC students fcus n harm reductin and preventin. At the same time, MCCC fully supprts thse wh chse t remain abstinent frm the use f alchl r ther drugs, and it seeks t prvide a brad array f activities that are alchl and drug-free. MCCC Plicy Addressing DFSCA MCCC is cmmitted t having alchl free and drug free campuses. MCCC plicies and prcedures are available n the MCCC Human Resurces website. The entire set f infrmatin pages site are available t faculty, staff and students. In cmpliance with the Drug-Free Schls and Cmmunities Act, the fllwing MCCC plicies are in place: MCCC Drug and Alchl Plicy The Cllege affirms its respnsibility and cmmitment t maintain a drug-free wrkplace. The Cllege prhibits the unlawful manufacture, distributin, dispensing, pssessin, r use f cntrlled substances n Cllege prperty r while cnducting Cllege business ff Cllege premises. The Cllege Bard f Trustees require strict cmpliance t the Drug-Free Schls and Cmmunities Act Amendment f 1989, Public Law , as the same may frm time t time be amended. MCCC is cncerned abut the health and welfare f its emplyees and students. The Cllege recgnizes alchl/drug dependency as an illness and a majr health prblem. The Cllege als supprts the state and federal laws regarding substance abuse and strives t create a healthy and prductive academic, wrking and scial envirnment. The abuse f alchl and drugs raises nt nly serius health issues fr thse invlved, but als can lead t accidents, pr prductivity, prperty damage and even persnal injury. In cmpliance with the federal Drug-Free Schls and Campuses Regulatins, as well as the federal Drug-Free Wrkplace Act, MCCC has adpted a plicy that requires emplyees and students t assist in maintaining a campus envirnment free frm the effects f alchl, drugs r ther intxicating substances. Emplyees are prhibited frm the fllwing when reprting fr wrk, while n the jb r perfrming jb related functins regardless f lcatin, while attending any Cllege-related activity, while n campus, r while in any vehicle used fr Cllege business. Similarly, students are prhibited frm the fllwing when attending classes, when attending any Cllege-spnsred activity r prgram, regardless f the lcatin, while n campus, r while in any vehicle used fr Cllege business. Specifically, emplyees and students are prhibited frm the fllwing: The unlawful use, pssessin, transprtatin, manufacture, sale r ther distributin f an illegal r cntrlled substance r drug paraphernalia, r the misuse f r distributin t anyne ther than the persn t whm prescribed, f any prescriptin drug. The unauthrized use, pssessin, transprtatin, manufacture, sale r ther distributin f alchl. Being impaired by alchl regardless f bld alchl level, r having a bld alchl level f legal limit, whether visibly impaired r nt.

4 Having a detectable amunt f an illegal r cntrlled substance in the bld r urine (whether visibly impaired r nt), r abuse f any cntrlled substance r prescriptin medicatin. MCCC Alchl Prcedures The prcedures in place have been established t facilitate the implementatin f Plicy 6.21, Drug and Alchl Plicy. The implementatin f the prcedure is the respnsibility f the President r his r her designee. Prcedure vilatins will be handled thrugh apprpriate Cllege disciplinary plicies and prcedures. Alchlic beverages 1 will be permitted n campus r sld r prvided by the District at any Cllege-spnsred event ff campus nly if apprved in writing by the Cllege s President r the President s designee. Apprval fr such events must be requested in writing at least thirty (30) days in advance f the prpsed event. Presidential apprval fr the availability f alchl under this prcedure will nrmally require the fllwing: Alchlic beverages shall be served by a licensed vendr and/r their emplyees wh are f legal age t serve alchlic beverages and are trained in bartender s alchl management techniques. Spnsrs f an event must implement precautinary measures t ensure that alchlic beverages are nt accessible r served t persns under the legal drinking age r t persns wh appear intxicated. 2 Alchlic beverages shall be sld, furnished and cnsumed nly within the area apprved and designated fr the event. Nn-alchlic beverages must be available and identified at the same place as alchlic beverages and be featured equally and at least as prminently as the alchlic beverages. N event shall include any frm f drinking cntest in its activities r prmtin. Advertisements fr any Cllege event where alchlic beverages are served shall nt fcus n the availability f alchlic beverages. Spnsrs f the event shall cmply with the terms f any Cllege insurance plicy, if any is required. MCCC Student Cde f Cnduct Item that Pertains t the DFSCA Mnre Cunty Cmmunity Cllege is cmmitted t maintaining a teaching and learning envirnment that fsters critical thinking, creativity, persnal integrity and psitive self-esteem. The intent f the Student Cde f Cnduct is t define a cllegiate standard f behavir and t describe the actins t be taken if a persn disregards this standard. As such, Mnre Cunty Cmmunity Cllege s standards f cnduct clearly prhibit the illegal use, pssessin r distributin f alchlic beverages, narctics, r cntrlled substances, r public intxicatin. The entire MCCC Student Cde f Cnduct and Due Prcess With Regard t Discipline Other Than Academic is lcated in the MCCC Cllege Catalg and Semester Class Schedule, as cpies are available in the Admissins Office and in electrnic frmat n the Cllege s website. 1 Alchlic beverage means any spirituus, vinus, malt r fermented liqur, liquids and cmpunds cntaining ne-half f ne percent r mre f alchl by vlume that are fit fr use fr beverage purpses. 2 Alchlic liqur may nt lawfully be sld, traded r therwise furnished t a persn under the age f 21 years. It is a misdemeanr t knwingly sell r furnish alchlic liqur t a persn under the age f 21 r t fail t make a diligent inquiry as t whether the persn is under the age f 21.

5 Substance Abuse Results in Health Risks Numerus health risks have been identified with substance abuse (use f illicit drugs and excessive use f alchl). Abusers can lse resistance t disease, develp physical and psychlgical dependence, becme depressed, develp heart prblems, cntract infectins, r becme malnurished, physically exhausted, and even die. Reality is ften distrted, reactins may be slwer, and the risk f accidents can increase. Extended substance abuse can cause cma, respiratry arrest, and cnvulsins. Injected drugs increase the risk fr infectius diseases such as hepatitis and AIDS. Bdy systems are affected. The liver, lungs, and heart are damaged. Fr wmen, there is an increase in birth defects assciated with use during pregnancy. Specific Alchl Related Health Risks Alchl cnsumptin causes a number f marked changes in behavir. Even lw dses significantly impair the judgment and crdinatin required t drive a car safely, increasing the likelihd that the driver will be invlved in an accident. Lw t mderate dses f alchl als increase the incidence f a variety f aggressive acts, including spuse and child abuse. Mderate t high dses f alchl cause marked impairments in higher mental functins, severely altering a persn s ability t learn and remember infrmatin. Very high dses cause respiratry depressin and death. If cmbined with ther depressants f the central nervus system, much lwer dses f alchl will prduce the effects just described. Repeated use f alchl can lead t dependence. Sudden cessatin f alchl intake is likely t prduce withdrawal symptms, including severe anxiety, tremrs, hallucinatins, and cnvulsins. Alchl withdrawal can be life-threatening. Lng-term cnsumptin f large quantities f alchl, particularly when cmbined with pr nutritin, can als lead t permanent damage t vital rgans such as the brain and the liver. Mthers wh drink alchl during pregnancy may give birth t infants with fetal alchl syndrme. These infants have irreversible physical mental deficiencies. In additin, research indicates that children f alchlic parents are at greater risk than ther yungsters f becming alchlics. Prgrams Addressing Alchl and Drug Use and Abuse Alchl-Free Activities MCCC ffers a brad range f alchl-free activities (campus speakers, cncerts, mvie nights, leadership cnferences,) that invlve student clubs and rganizatins, academic pprtunities, scial prgrams, and thers. Sme f these activities specifically target evening audiences s as t divert high-risk evening drinking int pr-scial activities. All student activities are alchl-free events. There are a number f student activities thrughut the year that encurage student participatin while in a fun alchl-free envirnment. A sample f student activities that tk place ver the last tw years include prm night, petry night, student club activities, mvies, cncerts, cmedians, speakers, etc. Human Resurces Office The Directr f Human Resurces, Mlly McCutchan, meets ne-n-ne with all new emplyees and reviews the MCCC Drug and Alchl Plicy. MCCC is interested in the cntinued gd health and persnal well-being f the emplyees and students and we recgnize that emplyees and students

6 suffering frm alchl r drug dependence can be treated. Emplyees and students may cntact the Directr f Human Resurces at (734) r designee fr a referral service. Any such cntact will be kept in strict cnfidence except insfar as may be required by law. In additin, emplyees may be entitled t apply fr a Family Medical Leave under the Family Medical Leave Act s that they may address a substance abuse prblem prir t it impacting their ability t d their jb. Emplyee Assistance Prgram (EAP) All emplyees, including Student Assistants, and dependents may cntact directly the Cllege s EAP, which is serviced by Prmedica Mnre Reginal Hspital, Reginal Behaviral Health by calling (734) Lcal assistance may als be available thrugh this hspital. In additin, emplyees may be entitled t apply fr a leave f absence s that they may address a substance abuse prblem prir t it impacting their ability t d their jb. Emplyees and students are encuraged t seek prfessinal care and cunseling prir t any vilatin f the relevant MCCC plicies. Other Resurces ADA Crdinatr All emplyees, including thse wh d nt qualify fr Family Medical Leave, may be eligible fr jb prtected leave r ther reasnable accmmdatins under the ADA if they have a qualifying disability. This infrmatin was included as these statistics have a bearing n the level f effectiveness f MCCC s educatinal effrts related t the DFCSA.
