SUGGESTED MOTION Adopt Rsolution INTRODUCTION/BACKGROUND Th Citizn Involvmnt Guidlins for Lak Oswgo (CIG, Attachmnt 6) stat that th Commission for Citizn Involvmnt (CCI) will mak rcommndations to th City Council on th rcognition of nw nighborhood associations, and that th City will rcogniz a nighborhood association as rprsntativ of th nighborhood whn th following critria hav bn mt: a. That wll-publicizd gnral nighborhood mtings hav bn hld for th purpos of information, organization, adoption of minimum bylaws, stablishmnt of boundaris and lction of officrs. b. That nams, addrsss and phon numbrs of officrs and board mmbrs and addrsss of currnt mmbrship b fild with th City and annually updatd. c. Writtn notic may b givn prsonally or by mail, fax, or -mail. (CIG p. 13) Th Commission for Citizn Involvmnt mt on May 9, 2016 to mak a rcommndation to City Council. Th Commission found that Mt. Park has complid with th Citizn Involvmnt Guidlins, and rcommndd that City Council rcogniz Mt. Park as a nighborhood association (s Attachmnt 5 for mting minuts). DISCUSSION Mountain Park is Lak Oswgo s largst nighborhood by population, with ovr 3,000 housholds and ovr 8,000 rsidnts. It is th largst ara of th city that is currntly without nighborhood association rcognition. Th Mountain Park Hom Ownrs Association is govrnd by a svn-mmbr voluntr board and has a longstanding organizational structur, programming and communication systm. In rcnt yars, th Mountain Park Hom Ownrs Association (MPHOA) board has bn working to pursu rcognition for this ara as a Lak Oswgo Nighborhood Association, dsiring to crat a mor formal rlationship with th City and to bcom part of th city s ntwork of nighborhoods. In March of 2015, th MPHOA mmbrship at thir annual mting unanimously approvd a motion to sk formal rcognition as a City of Lak Oswgo Nighborhood Association (NA). Th MPHOA board thn considrd how to structur th rlationship btwn th HOA and NA. In August 2015, th Commission for Citizn Involvmnt (CCI) hlpd th MPHOA to xplor thir options and undrscord th importanc of including among th NA mmbrship not just proprty ownrs, but all rsidnts, including rntrs. On Novmbr 9, 2015, th MPHOA board votd to stablish a Mountain Park Nighborhood Association as a compltly sparat ntity from th MPHOA board, basd on rquirmnts outlind in th Citizn Involvmnt Guidlins and bylaws approvd by th City. On March 16, 2016, a gnral mmbrship mting was hld to stablish th Mountain Park Nighborhood Association and to lct officrs. A mting notic (Attachmnt 2) was maild to approximatly 1,200 housholds, businsss and organizations locatd within th proposd boundaris. In addition, th mting notic was distributd via mail to all rsidnts of Mountain Park and was postd on th publicly-accssibl wbsit for MPHOA. Th City s nighborhood mting signs wr postd at four ky locations in th nighborhood A nu PO BOX 369 Lak Oswgo, OR

3 Pag 3 Th nighborhood association has submittd documntation to th City to mt th critria outlind abov, including a nighborhood association board rostr (Attachmnt 3), association boundaris (Attachmnt 1, Exhibit A), and bylaws rviwd and approvd by th City (Attachmnt 1, Exhibit B). Th currnt Mountain Park NA board includs mmbrs of th HOA board along with othr nighbors, including a rntr and townhous rsidnt. In stablishing th Mountain Park NA boundaris, a chang in th Oak Crk Nighborhood Association boundaris is also proposd (Attachmnt 1, Exhibit C). A portion of th Mountain Park HOA locatd along Kingsgat Road was includd in Oak Crk s boundaris whn thy wr rcognizd ovr 15 yars ago. Consistnt with th nighborhood boundary critria rlating to common land us pattrns, history and govrnanc (CIG, p. 10), it maks sns for this ara to b part of th Mountain Park Nighborhood Association. A lttr of support from th Oak Crk nighborhood association is includd as Attachmnt 5. ALTERNATIVES & FISCAL IMPACT Rcognition of th Mt. Park nighborhood dos not rsult in dirct cost incrass. Th City allocats funds to support th ovrall nighborhood association program, including nwslttr printing and mailing, th Nighborhood Enhancmnt Program, and staff support, but dos not distribut funds dirctly to ach nighborhood association. From th City s prspctiv, rcognition of Mt. Park provids an avnu to shar information and incras citizn involvmnt in this ara of th city, which may indirctly rduc costs associatd with rsponding to individual citizn contacts and rqusts for information. RECOMMENDATION Th Mountain Park nighborhood has mt th critria rquird for rcognition by th Lak Oswgo Citizn Involvmnt Guidlins. Staff rcommnds that th City Council adopt Rsolution (Attachmnt 1) rcognizing th Mountain Park Nighborhood Association and stablishing its boundaris as dpictd in Attachmnt 1, Exhibit A. ATTACHMENTS 1. 8 BYLAWS of th MOUNTAIN PARK NEIGHBORHOOD ASSOCIATION EXHIBIT B Rsolution (PP ) ARTICLE I: NAME Th nam of this association is th Mountain Park Nighborhood Association. ARTICLE II: PURPOSE Th Mountain Park Nighborhood Association (th Nighborhood Association) xists within and srvs th sam community as th Mountain Park Homownrs Association (MPHOA). Th govrnanc of th Nighborhood Association, as dscribd blow, is compltly sparat from and is not in conflict with th govrnanc of th Homownrs Association, spcifically th Bylaws of th Mountain Park Homownrs Association. Th purpos of th Nighborhood Association is to provid a forum for th mmbrship to discuss mattrs of common concrn and to rprsnt th viws of th mmbrs bfor public bodis. Mattrs of common concrn includ, but ar not limitd to, th livability of th nighborhood, city and rgion; participation in all phass of govrnmnt procsss with spcial mphasis on planning and land us,.g., land us, zoning, housing, community facilitis, human rsourcs, social and rcrational programs, traffic and transportation, and nvironmntal quality; and ongoing communication with Govrnmnts. Th Nighborhood Association may also undrtak such activitis as authorizd for nighborhood associations pursuant to th City of Lak Oswgo s Citizn Involvmnt Guidlins. ARTICLE III: MEMBERSHIP AND BOUNDARIES Sction 1. Mmbrship shall includ th following prsons rsiding or owning proprty or businsss within th nighborhood association boundaris: A. Rsidnts who ar ightn yars of ag or oldr; B. Ownrs of proprty; C. Rprsntativs of nonprofit organizations; D. Rprsntativs of ach public school; and E. Ownrs or managing agnts for businsss. Sction 2. Mmbrs of th Board of Dirctors ar lctd by a simpl majority of thos Association mmbrs prsnt and voting at th annual gnral mmbrship mting plus all duly crtifid proxy vots that may b rcivd. ARTICLE VII: MEETINGS Sction 1. Gnral mmbrship mtings ar hld at last onc a yar. Additional mtings may b calld by th Board. Th Board will call a gnral mmbrship mting within fiftn days if such a mting is rqustd in writing by at last twnty mmbrs of th Association. Sction 2. Writtn notic of th annual gnral mmbrship mting and lction of mmbrs of th Board of Dirctors shall b distributd to all mmbrs of th nighborhood association, City anning Commission and City Staff. Writtn notic may b givn prsonally or by mail, fax, or -mail. Notic of gnral mmbrship mtings, othr than th annual gnral mmbrship mting, shall b givn in th sam mannr as st forth in Articl IV.B, Subsctions 1, 2 and 3. Sction 3. A quorum for gnral mmbrship mtings consists of thos mmbrs in attndanc. Excpt as providd in ARTICLE IX, a dtrmination of any qustion or issu at a gnral mmbrship mting is a majority of thos prsnt and voting on th qustion or issu. ARTICLE IX: AMENDMENTS Ths Bylaws may b amndd through a gnral mmbrship mting of th Association by a two-thirds favorabl vot of th mmbrs prsnt. Bfor a mmbrship vot can b takn, th txt of th amndmnt must b rad in full, a copy of th txt must b rasonably availabl to th mmbrship and notic of th proposd amndmnt must b givn in accordanc with ARTICLE VII, Sction 2. No provision of th Bylaws rquird by th City of Lak Oswgo s Citizn Involvmnt Guidlins may b amndd without th writtn consnt of th City of Lak Oswgo.
